Texas Rule XIII, Section 8 specifically disqualified law graduates from online or correspondence programs. And though that might have made sense in 1985, it didn’t in a post-pandemic world where most education had shifted online.
Most would have walked away.
Nelson fought back.

Over four years and two application denials, Nelson waged a strategic legal battle. He assembled a legal team, provided exhaustive documentation, engaged the media, and ultimately filed a petition for administrative review with the Texas Supreme Court.
His argument was simple: Online legal education, when done right, is not inferior. It is different—and in many cases, more accessible and equally rigorous.
Nelson submitted affidavits from deans, expert testimony, and evidence of professional conduct. His clients spoke up. His firm’s performance backed him up. And his persistence forced the conversation Texas had been avoiding for years.
The Texas Supreme Court agreed. In May 2025, they issued an order recognizing Nelson's qualifications and authorizing his admission to the Texas Bar.
